1. Agreement to Terms

By accessing or using Sorted (sortedapp.ai), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not use our service.

Sorted is operated by Green Soles, a UK-based business located in Lancing, West Sussex.

2. Description of Service

Sorted is an AI-powered listing tool for preloved clothing resellers. We provide:

• Photo analysis using OpenAI GPT-4o Vision
• Automated listing generation (brand, size, colour, material, condition)
• Smart pricing suggestions
• eBay-ready CSV file generation
• Email delivery of completed listings

Important: Sorted is a tool to assist you — it does not guarantee accuracy, sales, or eBay acceptance. You are responsible for reviewing and approving all listings before uploading to eBay.

3. Account Registration

To use Sorted, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Keep your password secure and confidential
• Notify us immediately of any unauthorised account access

You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these terms.

4. User Responsibilities

You agree to:

• Own or have permission to upload all photos you submit
• Review all AI-generated listings for accuracy before using them
• Comply with eBay's policies (or any other marketplace you use)
• Use Sorted for lawful purposes only
• Provide your own OpenAI API key and manage your usage costs
• Not share your account with others (unless on a Business/Team plan)

5. Prohibited Uses

You may not use Sorted to:

• Upload photos you don't own or have permission to use
• Upload illegal, obscene, or adult content
• Upload copyrighted brand imagery (e.g., official product photos from brand websites)
• Attempt to reverse engineer, decompile, or hack the service
• Abuse API quotas or attempt to bypass rate limits
• Resell or white-label Sorted without written permission
• Use automated scripts or bots to scrape or spam the service
• Violate any applicable laws or regulations

Violation of these rules may result in immediate account termination without refund.

6. Intellectual Property

Your Content:

• You retain all rights to photos and content you upload
• You grant us a limited licence to process your photos for the purpose of providing the service
• We do not claim ownership of your listings or generated content

Our Content:

• Sorted's code, design, branding, and algorithms are our intellectual property
• You may not copy, modify, or redistribute our software without permission

7. Subscription Plans & Pricing

Sorted offers multiple subscription tiers:

• Free: Unlimited listings (during beta), £0/month
• Starter: 100 listings/month, £19/month
• Reseller: 300 listings/month, £39/month
• Power Seller: 800 listings/month, £79/month
• Bulk: 2,000 listings/month, £149/month
• Limitless: Unlimited listings, £299/month

Prices are in GBP and exclude VAT (where applicable). Billing is monthly via Stripe. We reserve the right to change pricing with 30 days' notice.

8. Payment Terms

• All subscriptions are billed monthly in advance
• You authorise automatic billing to your chosen payment method
• If payment fails, your account may be downgraded or suspended
• You are responsible for OpenAI API costs (charged separately by OpenAI)

9. Cancellation & Refunds

Summary:

• You can cancel anytime via Settings
• Access continues until the end of your billing period
• No pro-rata refunds for partial months
• Refunds available within 7 days if technical issues prevent service use

10. Service Availability

We strive for 99.9% uptime, but we do not guarantee uninterrupted service. Sorted may be unavailable due to:

• Scheduled maintenance (we'll notify you in advance)
• Third-party outages (OpenAI, Vercel, Cloudflare, etc.)
• Security incidents or emergencies

We are not liable for losses caused by service downtime.

11. No Warranty

Sorted is provided "AS IS" without warranties of any kind, express or implied.

We do not guarantee:

• Accuracy of AI-generated listings (brand, size, price, etc.)
• Acceptance of listings by eBay or other marketplaces
• Sales or revenue from using Sorted
• Error-free or virus-free operation

You are solely responsible for verifying all listing details before uploading to eBay.

12. Limitation of Liability

To the maximum extent permitted by law, Green Soles and Sorted shall not be liable for any:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from incorrect listings or AI errors
• Damages caused by third-party services (OpenAI, Stripe, etc.)

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months prior to the claim, or £100, whichever is greater.

Nothing in these terms excludes liability for death/injury caused by negligence, fraud, or other matters where liability cannot be excluded under UK law.

13. Indemnification

You agree to indemnify and hold harmless Green Soles, Sorted, and our affiliates from any claims, damages, or expenses arising from:

• Your use of Sorted
• Your violation of these Terms
• Your violation of third-party rights (copyright, trademark, privacy, etc.)
• Content you upload to Sorted

14. Termination

We may suspend or terminate your account at any time if:

• You violate these Terms
• Your payment fails
• You engage in fraudulent or abusive behaviour
• We discontinue the service (with 30 days' notice)

You may delete your account anytime via Settings. Upon termination:

• Your access to Sorted ends immediately
• Your data is deleted within 90 days (except where legally required to retain)
• No refunds are issued for remaining subscription time

15. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of Sorted after changes constitutes acceptance of the new Terms.

For material changes, we'll email you at your registered email address at least 14 days in advance.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
